1. Acceptance of Terms
By accessing or using the Auto Connect Marketplace ("Platform"), operated by Auto Connect ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not use the Platform.
2. Description of Service
Auto Connect is an online marketplace that connects vehicle buyers, private sellers, and licensed dealers. We provide a platform for listing, browsing, and facilitating the sale of automobiles. Auto Connect is not a party to any transaction between buyers and sellers and does not take ownership or possession of any vehicle.
3. User Accounts
To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must provide accurate and complete information during registration and keep your account information up to date.
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or are otherwise detrimental to the integrity of the Platform.
4. Dealer Accounts
Licensed dealers must provide a valid dealer license number during registration. Dealer accounts are subject to verification. Dealers are responsible for the accuracy of all vehicle listings, including pricing, specifications, images, and vehicle history. Misrepresentation of a vehicle's condition or history may result in account termination.
5. Private Seller Listings
Private sellers may list vehicles for sale by purchasing a listing package. Listing fees are non-refundable once payment is processed. Private sellers represent and warrant that they are the legal owner of any vehicle listed and have the authority to sell it.
6. Concierge & Financing Services
Auto Connect offers optional concierge and financing facilitation services for an additional fee. These fees are non-refundable and cover the cost of professional assistance, document review, and coordination services. By purchasing these services, you acknowledge and agree to the non-refundable nature of the fees.
7. Payments & Refund Policy
All payments are processed securely through our third-party payment processor (Stripe). By making a payment, you agree to Stripe's terms of service. All service fees paid through the Platform — including listing fees, concierge fees, and financing facilitation fees — are non-refundable.
Auto Connect does not process payments for the actual purchase of vehicles. Vehicle transactions are conducted directly between buyers and sellers.
7a. Auction Fees
Live auctions follow a separate fee model: sellers list free and pay $0 at closing, receiving 100% of the accepted bid. The winning dealer pays a 3% buyer fee at closing (minimum $5,000, capped at $25,000), places a 5% lock-in deposit on acceptance (credited toward the purchase), and covers the Escrow.com fee at published rates. 8. Prohibited Conduct
- Posting fraudulent, misleading, or inaccurate vehicle listings
- Using the Platform to launder money or engage in illegal activities
- Attempting to circumvent the Platform to avoid applicable fees
- Harassing, threatening, or abusing other users
- Scraping, crawling, or automated data collection without written permission
- Interfering with the security or operation of the Platform
9. Disclaimer of Warranties
The Platform is provided "as is" and "as available." We make no warranties, express or implied, regarding the accuracy of any vehicle listing, the condition of any vehicle, or the reliability of any user. Auto Connect does not inspect, certify, or guarantee any vehicle listed on the Platform.
10. Limitation of Liability
To the maximum extent permitted by law, Auto Connect shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, any transaction between users, or any vehicle purchased through the Platform.
11. Indemnification
You agree to indemnify and hold harmless Auto Connect, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.
12. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Platform. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
